Access to Remedy

An effective human rights protection mechanism necessitates the availability of remedial processes capable of resolving grievances (unfair compensation, land grabbing, low wages, environmental pollution, etc) for damages incurred from business operations. From this standpoint, Business and Human Rights Tanzania (BHRT) advocates for establishing robust and functioning grievance mechanisms to provide remedies in case corporate operations adversely impact community members.

The United Nations Guiding Principles on Business and Human Rights (UNGPs -HR) provide an essential framework for addressing the impacts of human rights violations arising from corporate operations. This framework is instrumental in navigating the intricate landscape of responsible business conduct, ensuring that due diligence processes align with human rights obligations and that companies effectively manage their impact on rights holders.

These principles delineate the obligation of States to enact and enforce comprehensive measures aimed at preventing, investigating, punishing, and providing remedies for business-related human rights abuses. This proactive approach promotes collaboration and accountability mechanisms and fosters a safer and more equitable landscape for the affected parties.

To ensure meaningful adherence to human rights standards, it is essential to uphold, protect, and promote the well-being of the community members. This entails implementing robust legal frameworks that facilitate access to remedies for victims of human rights violations, fostering social and economic justice. Furthermore, to effectively uphold this principle in Tanzania Corporate sector, Business and Human Rights Tanzania (BHRT), has been contributing to promote access to remedies via Public Legal Education to the communities adjacent to investment projects on natural resources human rights monitoring, mentoring victims of violations of human rights to access remedies, advocating for legal reforms on natural resources governance and empowering community members to engage the government and corporate entities to dialogue issues related to natural resources governance.
